Legal Question in Consumer Law in Texas

Auto Title

My sister purchased a pickup truck for her grandson, January '09, she payed $6000.00 cash. She needs her name off of the title,(currently in her name and grandson's name) but because the grandson and now former girlfriend bought a car last summer from this same salesman and she is behind on monthly payments(she is in has the car), the guy will not release the title of the truck to my sister. He has told her on a couple of occasions that she could get the title but each time she attempted to get it, he put her off with excuses. He is also using scare tactics by telling her that he is going to put her grandson in jail if she does not give him the address of the location where the car is kept. She does not have that information but never-the -less, the guy continues the threat. She does not know how much information her grandson has but she has told him to give up what he's got.

Is there anything more she can do beside demanding the release of the title. She is 60yrs old and her health is not good. She lost her husband in July '08 and June 15th, '09 she is moving from Texas to Virginia to live with me. She needs to resolve this issue before her move date. Any advice wil be greatly appreciated.

I am confused by your question. You state that she wants off of the title, but then say she is trying to get the title.

I cannot tell from your question what her actual problem is, and if she is entitled to relief, but she can start with the Texas Department of Transportation, who governs title issuance by dealers. They may be able to resolve her problem without going to court.
