Legal Question in Consumer Law in Texas

Automotive

I took in my car to be repaired at ABC Service Station because of a loud winding noise I was hearing while driving at moderate speeds. They diagnosed the problem as being my tires that were making the noise. I had all four tires replaced and to no avail when I left the station the noise was still there. They then told me it was the transmission that would have to be torn apart and rebuilt at aprox. $3200.

Because of my suspicions with this company I took my car into the dealership where they told me that the noise had nothing to do with the transmission and that the problem was the front and rear wheel bearings on the front driver's side. They quoted me $800 to fix the problem.

Can I do anything to get some sort of compensation from ABC Service Station when it is obvious that they were trying to take me for a hefty ''high dollar'' ride? I just recently became unemployed and spent a little over $700 getting all four tires replaced needlessly. I could have used that money to fix the real problem. Your advice would greatly be appreciated.

I recommend suing them in small claims court. You can act as your own attorney or hire an attorney, and the filing fee is less than filing in County or District Court. There are specific rules for filing suit so that it is filed in the proper Justice court. Have you spoken to anyone at the service station regarding this issue? Many times a reputable company will work with you. If not, a suit may be your only recourse.
