Legal Question in Consumer Law in Texas
Bait and Switch
I recently signed up with a car sponsorship company. Here was the process:
-I enter my vehicle information.
-I check the ''Body Kit'' box, indicating I'm interesting in being sponsored to put a body kit on my car.
-I click ''Check Availability.''
-Some process runs, and after a few seconds the next page displays the message:
''Sponsorship Contracts available from - Blaupunkt USA, Tsunami Audio, Dunlop Tires, Fidanza Motorsports, Kyowa Wheels, Hot Import Nights, XM Radio, DEi Design Engineering, BodyKits Etc, GlowShift Gauges, Auto-Air Colors, Performance Auto & Sound Magazine, Decalkits, StreetFX, Stoner Car Care Products, R-Blox Sound Control and many others''
-BodyKits Etc. is a company that sells body kits for cars.
-I was happy with the results, thinking I would be able to be sponsored for a body kit.
-There was a $96 charge.
-When I was all signed up, charge paid in full, I was able to begin the sponsorship process.
-When I did so, I found out Body Kits Etc. does NOT have a body kit for my vehicle.
My qualm: before signing up, I was told Body Kits Etc. had a contract available for ME, when in fact they did not because they don't have a body kit for my car. Is this not BAIT AND SWITCH?

No. Bait and switch is when you come in to buy the advertised merchandise and it is not as advertised or "just sold the last one" and they move you into another higher priced model. They never had the advertised model at all. Although you might be a victim of consumer fraud. Report this to the AG's office.
