Legal Question in Consumer Law in Texas

Used Boat Title

I purchased a used boat from a boat dealership on April 1st 2008 for $1500 cash. The owner of the dealership did not have the title because it was a consignment boat as he stated to me in the beginning.

I had several problems with the boat in the beginning so the owner agreed to replace the outboard motor at no cost to me. He did state however that it would be low priority because he was doing it out of the kindness of his own heart.

Three weeks later the boat was repaired and I took ownership of the boat in good working condition. Since then i have questioned him several times about getting the title to the boat and he is telling me that he will get it and call me back and we are now in the third month of him saying that someone else has the title, he will call them and call me back.

He never calls me back and is now completely avoiding my calls because i stated to his employee that i wanted to return the boat and get my money refunded. i have a hand written reciept for the amount of purchase.

After all the trouble i do not want this boat, what can i do?

Thank you

Re: Used Boat Title

You might want to retain a lawyer to write a letter explaining the laws and regulations surrounding dealership licensing and providing titles. It might cause him to rethink his position.
