bought a lemon

i bought a ''lemon'' from an individual. he gave me a written warranty on the transmission(three months) it went out after 3 days. the man said he would fix it but then said it would cost too much and would giv me my mony back. nothing has happened and three months will be up thursday. he keeps giving excuses. what can i do?

Thanks for your question. Although your vehicle probably does not qualify under the Texas lemon law (because it was used and purchased from an individual), it sounds like you certainly have at least a breach of contract case against the seller. You can file suit in a justice court (as long as the total value of damages sought is under $10k and you are looking to collect money only, not an order to have him repair the vehicle).
