Legal Question in Consumer Law in Texas
I bought a new mattress from a local business and when I went to pick it up a few days later they had sold it to someone else and did not have another to replace it at this time. Wouldn't that be considered stealing since they have my money and I do not have a product?

No but it would be breach of contract and perhaps other civil claims. I'd suggest asking for your money back and taking your business elsewhere.
