Brake Check causes damage to vehicle

My daughter took her vehicle to get her brakes serviced at Brake Check.

After approximately 6 months, one day with no previous warnings (noise, tire bouncing, etc) the front drivers wheel started bouncing drastically on the freeway at 70mph. While trying to steer the vehicle off the freeway, the drivers side front wheel flew off the car, bounced against the center median and flew up to land in the back of the truck, causing damage to the front wheel and body damage. The dealer noticed that there was a puncture in the bearing cap caused by a screwdriver, which caused the bearings to break down over time. Brake check has agreed to pay only 50% of the damages (3K ttl), because they feel that customer negilgence contributed to the problem. Is this worth attempting to persue via legal action for the remaining 50%, or should we be happy for any settlement?

If you know how to file a lawsuit, then you could decide how much time & how much money you want to spend for $3000.

Based on what you have stated, it appears that Brake Check is attempting to mitigate their damages and not accept responsibility.
