Breach of contract

I have a signed contract for cabinetry in my kitchen. The builder is stalling and not returning my calls. We gave the deposit on January 26, 2007. What is the next step if I want my money back?

Sending a demand letter; do the work or return my money.

If he doesn't do the work, the next letter states that he has breached the contract and you want your money back.

If he doesn't return the money, then you can sue him.

Mr. Bradie is right on the money (no pun). In addition, the law provides criminal penalties for deceptive business practices. If he refuses to return your money, you can also file a criminal complaint. The office of the County Attorney usually processes these kinds of cases. Call and find out if that is the case in your county.
