Legal Question in Consumer Law in Texas

Capri Sun

I purchased some Capri Sun fruit juice (made by Kraft) for my son (3 years old). For the next few days he became ill and slept alot. After three days of this, I happened to take a sip from what was leftover that day from his juice and it tasted like wine. I contacted Kraft and they said this happens from time to time because they use real fruit and it can become fermented. When I asked why isn't this a warning label on the juice and she did not answer. She asked me to send in the juice and she will give me a coupon.

Do I have a case? Not only was my son ill, but it is against our religion to consume any alcoholic beverages.

You may have a product liability case; not a deceptive trade practice claim. Keep all of the Capri Sun's that have not been consumed and if you have an open package, keep that also. Did you take your son to the doctor? Please give me a call and mention LawGuru.com.
