Legal Question in Consumer Law in Texas
Car Accident
What are my rights concrening SUV repairs verses having the insurance company total my SUV and pay me fair market value. My SUV was involved in an accident with a king size fly bed, box spring, and frame at 60 mph. I didn't get hurt but my SUV had about $4,000 worth of damages. I steered to the insurance company preferred shop against my request to take my SUV to the dealership I usually frequent. The preferred shop tried three different times to repair my SUV, but couldn't do a adaquate job. The workmanship was very poor, incomplete, and sloppy. The preferred shop only tried to repair the cosmetic work not the manchanical problems. So I incurred additional damage and out of pocket cost. The inurance company agreed to pay for some of the machanical damage, but not all. The insurance company is willing to pay a shop to redo the sloppy repairs, but only for the right price. I have had my SUV examined by the three different insurance adjusters, one of which I recently met at the dealership to go over the damage. The insurance adjuster agreed to most everything on the estimate, but wanted the dealership to cut some corners in materials, time, and technique. The collision center manager informed that he wouldn't do the job
