Legal Question in Consumer Law in Texas

Car Fraud - misrepresentation of truth & more

Hello,

I bought 1998 Mercedes in 2001 that the dealer promised was in perfect condition. Recently, I've been informed that the vehicle had structural frame damage by the US Department of Transportation, National Highway Traffic Safety Adminstration, Odometer Fraud Staff.

I have been advised that the dealer's actions constitute fraud under the Texas Deceptive Trade Practices Act and as well as more. I want to sue the dealer.

I need a legel attorney for this matter.

You are correct. There should be many attorneys in your geographic area that handle DTPA lawsuits. This website has names of attorneys, as do many others.

You may have a problem, though, with the statute of limitations. The question is not when you found out the defect, but when you knew OR SHOULD HAVE KNOWN the defect.

The statute for the DTPA is two years, and breach of contract is four years.
