Legal Question in Consumer Law in Texas
Car Purchase Contract
Purchased car from dealership, signed contract for price, percentage rate & monthly payment. Next day dealership states GMAC does not want to finance. Dealer wants us to come in to get a cheaper vehicle. No mention of contract pending approval. Contract is signed from both parties with stated monthly payments, interest rate, and total price of vehicle. Can they make us return the vehicle? 0 down no trade in.

Generally, most auto dealers have the potential buyer sign an agreement or notice stating that the auto dealer will attempt to obtain the buyer financing at the terms stated in the contract. But in the event that such terms are not available, then the buyer will have to return the auto purchased or agree to alternative financing terms. You should read the documents that were signed closely or have an attorney review the documents. This dealer is engaging in bait and switch financing which is in violation of Federal credit laws. If you want to take action against the dealer, contact me be email. It might be possible that you would have a new car by Easter.
