Legal Question in Consumer Law in Texas
New Car Purchase
A contract was written by a dealership for a new vehicle with my husband noted as the buyer and me noted as the co-buyer. He signed the contract and left a personal check as a down payment. I have not signed the contract. We have not taken delivery of the vehicle. Are we legally bound by this contract? Can they cash the down payment check?

The dealership should be able to enforce the contract against the both of you. This is because any obligation entered into by either you or your husband is an obligation of the community estate. Just as you both own most assets acquired during the marriage, you both are responsible for most debts incurred during the marriage.
