Car Repair Issue

One week after I took my car in for a tune up and new timing belt, it broke down and I took it to the shop for repairs. It needed an engine overhaul and the warranty said this overhaul was good for 12 mos or 12K miles. Two weeks later it broke down again and I took it to the dealer. The dealer said the gasket was installed improperly and the other repair shop failed to order and install a new one. Is the previous repair shop responsible for the costs of these new repairs (since they did faulty work) or are they supposed to refund my money from their previous repair because of their warranty?

If the first shop was negligent in its repair of your vehicle and you can prove such negligence, then you would have a claim against it for negligence.
