Legal Question in Consumer Law in Texas
Car Sale
On April 15th, 2008 I purchased a 2006 Chrysler Sebring from John Keating Chevy. I traded my 2007 Mazda Miata Convertible for the Sebring. On April 28th I got a call from the dealership and they wanted me to come sign a new contract. They said they had made a mistake and paid off the wrong car and there was a $7000.00 difference on the deal and we would have to renegotiate the deal. I called my husband and several other people that are involved with contracts on a daily basis and every one said it was the dealer�s mistake and I had a signed contract that they could not do anything about it now. I have already gotten my loan on the new car and the payment is due on May 21st. The dealership is refusing to give me my license plates and said they are not going to do the deal. I have told them that I have a contract and they can not change that. The finance company said the same thing they have already been paid for the Sebring. I do not think they have paid the Mazda and the payment on that is now over due. I can not pay 2 car notes. Please help!!!

Based on what you have written and dependent upon what the terms of the contract are, you appear to have a valid cause of action against the dealer. It appears that the dealer is trying to take advantage of you.
