Legal Question in Consumer Law in Texas
Change of venue, from small claims to other
I have filed in small claims in my county against Blue Cross Blue Shield of Texas because they refuse to pay my
healthcare bills. I bought a $5000 deductible policy which would pay for anything over $5000 and I felt I was covered. my daughter's treatment is $8500 and BCBS refuses to pay, they initially claimed that this claim was not coded correctly and I requested the hospital to recode it, they did. BCBS responded to my small claims by asking for a change of venue to their county. I responded by asking the small claims court to refuse this change of venue.
Any suggestions?

Re: Change of venue, from small claims to other
The venue provisions for Small Claims are mandatory. The defendant must be sued in the county where their main office is located. The JP doesn't have any choice unless there are multiple offices in Texas.
