Legal Question in Consumer Law in Texas
Collection Agency
We had a truck being financed that we got behind on and it went to a collection agency. We made a few payments to the collection co. trying to get caught up and then called the note holder and asked for a payoff amount. We were given an amount and had an oral agreement the amount would be no more if the payment was overnighted (which it was). We received a fax from them stating they had received the payoff check and would need us to send a letter in requesting the vehicle be released to us. We have done that and now I get a call from someone else at their company saying they won't release it because we were supposed to go through the collection agency and there is still money owed. What are are options?

Sue them for breach of oral contract and -do it now!-.
