Compensation for Legal Fees
Most people assume that if they sue a person or corporation and win, they will be awarded legal and other fees associated with suing, in addition to any other award. I have been finding out from attorneys in our state and many others, that this is NOT so, even in fraud cases. What circumstances allow the winning party to be awarded legal or related fees if they win? Why is there a public misconception that you always get legal fees if you win, if this is not so?

Whether you are entitled to legal fees in the State of Texas depends on what theory of damages you recover on. For instance, breach of contract claims and consumer deceptive trade practices claims entitle you you attorney's fees at the court's or jury's discretion. Other causes of action do not entitle you to fees.
