Legal Question in Consumer Law in Texas

Consumer Fraud

I recently went to an oil change station to get my oil

changed. The guy who looked at my car told me there was no need to get an oil

change due to the oil level in my car and there was no need for him to take my

money. So I thanked him and left.

About a week later - I was contacted by an assistant of the district manager

claiming that one of their workers documented I had work done. She explained one

of the workers at this station is trying to setup another worker to get fired by

falsifying a report. I explained to them the situation and after meeting with

the district manager it was proven that no work was done.

The concern I have is I never signed anything or gave my name or address to

anyone, but they had that information. During one of my phone conversations with

the district manager I brought this to his attention. I was told that a worker

copied my license plate and acquired my name and address without my permission.

Basically he used my personal identity to falsify work done without my

permission.

Can I take legal action?

Re: Consumer Fraud

A civil action would be a waste of time and money. You may consider filing criminal charges for identity theft.

Re: Consumer Fraud

Identity theft is a criminal offense if the data is used to gain benefit for the thief. Other than that, it appears you have suffered no damage.
