Legal Question in Consumer Law in Texas
Creditor Harrasment
Last night I made a payment by phone to my mortage company for
my February payment. It was not 30 days past due. They
continued to harrass me for the March payment that is not even
due yet. Can they attempt to collect for a payment that is not due
or past due yet? Do they have the right to continue to try to collect
it when I tell them I will take care of it when it is due?
Thank you

Re: Creditor Harrasment
You have a serious misunderstanding of when payments are due. There's a date certain that payments are due, usually either the 1st or the 15th. One day past for a mortgage and the payment is overdue. You really don't have 30 days grace as a matter of law.
Being overdue on the February payment, they are obviously and understandably concerned about the March payment.
Jerk your mortgage company around enough and they'll accelerate the note and declare the entire balance due.
