Legal Question in Consumer Law in Texas

Daughter used Mothers Personal Credit Card without Permission

Daughter used Mom's personal - Signed credit card & made $75.00 purchase without permission. Daughter returned the necklace and got a store credit, the reciept does state Store Credit Only. I just happened to come upon this reciept without daughter knowing. I called credit card company to see if I had any rights to get a refund and they said only if I pressed criminal charges on my daughter. They suggested, see if the store with work with you and refund. This is the first time my daughter has done this, and hopefully the last. Do I have any rights as the credit card holder to get my money back from this store, since my card was signed, they DID NOT CHECK her I.D. or my signature when she purchased it. I feel as though I'm the victim in this, they got their product back and I'm getting stuck with a charge on my card and now a store credit. Thanks so much!

Re: Daughter used Mothers Personal Credit Card without Permission

No question that you are the victim. However, your daughter is the perpetrator. She is the one who duped the store in order to complete the theft. So, you either prosecute or take better care of your purse, credit cards and money; and hope this is the last time. Good Luck.
