Legal Question in Consumer Law in Texas
dealership fraud
we bought a 99 van and after recent service, found out that the van had been totaled and now being resold for full value. the dealer says they did not know this and in fact, do not even have the title yet. they have filed for a lost title. the dealer got it from a friend by word of mouth that the title was clear. what are we entilted to from the dealer to correct this problem?

I find it hard to believe the dealer didn't check the vehicle's history online. Anyway, I assume you bought it from a used car dealer. You may qualify for the TX lemon law. So research that online and then get an attorney so the dealer takes you seriously.

Hard to say. You may be entitled to set aside the contract of sale, return the van, and get your money back. Or you may only be entitled to damages; the difference between your purchase price and the actual value of the van.
In either event you'll need to hire a lawyer to look after your interests.
