Deceiptive Business Practice
we purchased a new home in March'02 from one of the area's largest builder. Within the first year we notice that the house frame on the back part of the house hung over the foundation by 1 1/2inches. In April '03 the builder had cement added to the foundation to fill-in/hide the overhang;this was not a proper repair. The builder stated, in a letter, that the improper repairs were recommended by an Engineer. They said they would send us a copy of the Engineer's report; which they failed to do. Our interior walls are cracking excessively in the area where the house frame is hanging over the foundation. And the border/molding is seperating away from the edge of the carpet, as if the wall has stated to move; and it's starting to scare me.In Oct.'04 I was told by a contractor that we had a major proplem. He stated that the wall, which is hanging over the foundation, is a load bearing wall and it needed to be supported. He stated that the builder did an improper repair, the added cement will not add any support and that the wall is and will eventually come down. Would this be a deceiptive business case, please advise. thank you

Without a doubt! But construction claims are a bit different than buying movable goods, so get hold of an attorney in your area that handles consumer construction claims ASAP.
