Dog Registration
I recently purchased a Pekingese puppy from Texas with the understanding that the litter was AKC Reg. When I tried to register the puppy in my name with AKC I was turned down due to a problem with the litter registration from the original owner. I paid $800 for the puppy with the intentions of breeding and selling puppies myself. I want to ad that the owner of the litter and the seller are two different people. I have repeatedly emailed and phoned the owner/seller to get the papers in order so that I may complete my side of the paper work. This has been ongoing since Oct. 2005. I have been told by email in Dec. 2005 that the paper work was sent in to AKC, but AKC has not yet recieved the correction. When I phoned, I only get an answering machine and my messages have not been returned. I recently emailed and phoned again but I get no response. This delema is costing me time and money. I will have a hard time selling puppies without registration. Registered dogs are sold for a better price.
What are my rights in this situation? What type of action should I take. Do I have the right to ask for my money back and return the dog, which I have come to love?

Adding to Mr. Grissom's answer, your damages are the value of the pup with papers versus the value without papers. Your potential lawsuit is with the seller who promised the papers.

If you wish to file a lawsuit, you will have to sue those people in their home county in TX. You would have all sorts of claims, breach of contract, deceptive trade, fraud, etc. What you are missing is an amount of damages to make this a viable case for an attorney, but maybe I'm missing something. Consult with an attorney in TX.
