Legal Question in Consumer Law in Texas

Duped by fake purse

My wife purchased a designer hand

bag on ebay and later found out it

was a fake. We contacted the seller

who claimed she did not know it was

a fake but said we had waited too

long to notify her. We were able to

get no assistance from ebay or

paypal because it was beyond their

45 day rule. When we contacted our

bank we were beyond their 120 day

rule. Is there a staute of limitation

on something like this? We

purchased the purse in Dec 2006.

Please help. Thanks

There's a 4 yr stat of limit on fraud. You could sue her inTX, but it's going to cost you as much as the purse - maybe more - maybe a lot more.

If the seller is out of the country or only has a shell company here, then you are out of luck. Think about the price you paid and what a real one costs. If they aren't close, forget about this. If they are, maybe you can go to small claims if you can find them in the US.
