Earnest Deposit

I hired a photographer to do an engagement sitting, bridal sitting, wedding and reception.

In his contract he states:

''I have received your contract and earnest deposit of $225.00. Please remit the remainder of the 50% deposit of $225.00 by August 2003.''

My question is- Does the term ''Earnest Deposit'' legally imply that the deposit is non returnable or does that fact have to be stated specifically.

The time frame for cancelling (due to dissatisfaction after the Engagement pictures were taken and the discovery that some ''verbal'' committments were not going to be honored) is 16 weeks and 4 days prior to the Wedding.

It's usually not refundable unless spelled out in the contract.
