Legal Question in Consumer Law in Texas
Ebay Lost shipment and Sender Not willing to file claim
I have purchased a computer from somebody through Ebay auction.
I have paid for this item through money order and requested seller to send item through USPS with insurance. Seller claims that he sent it as requested. But I have never received the item. When I contacted my local post office, they said thier system shows as if it was delivered but don't have information as to who received it. They said the item could have been lost. They have advised the sender to file a claim for insured amount.
The seller doesn't want to file claim as he thinks I'm lying. I'm wondering what I should do now.

Re: Ebay Lost shipment and Sender Not willing to file claim
Apparently, you paid for the shipment insurance for your own benefit. So, I don't understand why the seller is reluctant with following through with a claim. What detriment might s/he incur by not filing a claim? What records can USPS give you regarding this shipment? Date and time of delivery? Name of carrier who delivered it? Was it sent via certified or registered mail? You might remind the seller that negative feedback on E-Bay might affect his future business in this forum.
