Legal Question in Consumer Law in Texas

ebay scam

I recently won some sports tickets on eBay that cost me $2,000. The auction ended and the seller told me that she sent them regular mail. No insurance or anything, just regular mail. She told me that they should arrive in 5 days. But it's already been ten days and no tickets. I told her I wanted my money back, but she declined. She told me her aution stated NOT RESPONSIBLE FOR TICKETS ONCE LOST OR STOLEN. I told her I would sue, but she said she sent the tickets regular mail and has two witnesses that saw her drop off tickets at post office. But in the auction she stated I WILL ONLY SHIP UPS OR FED-EX. Would I have a case against her?

Re: ebay scam

If paid by credit card or PayPal, call them and immediately cancel the charge. If paid in some other manner, contact your attorney general's consumer fraud division, the Federal Trade Commission, and the Postal Inspector concerning mail fraud.

You have case against her, but collecting against a scammer is almost impossible.
