Legal Question in Consumer Law in Texas
can I file counterclaim after a judgement been issued in a small claim court. I gave a curtain designer to sew my curtains, She did not finish the work, I asked her to finish and she decided to charge me extra for the work. I refused to pay extra for her to complete the work. She sued me in small claim's court. I was not able to be on time due to an accident on the highway, I called the court and let them know the situation, for some reason the case was trailed with out my presence to defended myself. Judgement was issued aganist me. Can I counterclaim for damages?

You should be able to appeal to the County Court of Law. Check with an attorney on appealing a JP decision.
