Legal Question in Consumer Law in Texas

I gave this man $250.00 Dlls. in advance for landsaping work on my house he this was about 2 yrs.ago I have talked to him about returning my money he said he would return my money I have called him several times but it seem like he is hiding from me i have a receipt with his signature, I would apreciate an advice thanks.

Re: fraud
Send him a letter, certified mail, return receipt requested, demanding that he either return your $250.00 or do the landscaping within the next ten business days. If he fails to do either, you can sue him in Small Claims.
