Legal Question in Consumer Law in Texas

horse purchase

I purchased a horse over the internet and paid 2800.00 via wire transfer before the horse arrived. I was assured that this horse passed a veterinarian health check, was sound and safe for a beginning adult rider. I specifically asked the seller about the horses legs and feet and was assured that the horse had never had any problems with her legs or feet. The horse arrived lame, with obvious old injuries to legs and feet. I attempted to return the horse but was refused. I have all email correspondence and veterinarian reports stating that this horse has multiple issues with her legs, feet and a possible old spinal injury. What can I do to recover my money and return this horse? The horse was purchased from a person in Handy, TX and shipped from there to Santa Teresa, NM. Shipping cost 500.00 and I am paying a monthly boarding fee for a horse that cannot be ridden, has multiple leg and feet issues and has a questionable temperment.

If the seller haad any money, you could probably collect treble damages, attorney fees..etc...but hopefully you used an internet source, such as ebay whiich may provide some protection...on the internet especially BUYER BEWARE

Mr. McLeaish is correct that you took a big risk buying this horse online. You would have to sue in small claims where the defendant is located.
