Implied Warranty information
We purchased a 2002 Peterbilt in Dallas, TX on 5/3/06. The extended warranty was supposed to be for engine, trans., and differential. The original paperwork which was signed is blank, but after signature the dealership checked engine only and mailed our copies back to us. The transmission has just gone out of the truck and the warranty company says its not covered. I have the form that was not checked but signed by us and the form which was returned with the wrong box checked. Do we have any recourse?

Although the forms are apparently not filled out correctly, the fact that you paid the premiums for the extended warranty would be good evidence that the claim should be covered. This would be a Deceptive Trade Claim but your damages will depend upon whether a lawyer would take this case.
