Legal Question in Consumer Law in Texas
I initially received service from a vehicle service provider in December 2009, and as of today, April 3, 2010, the company cannot resolve the problem they initiated. I have done every process they requested, ultimately having me pay more for their service for an incomplete job. Now they have stated the are giving up, and don't know how to resolve the problem. This company adverstises that they can do the service the right way, for less price, for any vehicle, but in my situation none of this has occurred. They have consistently advised me the problem is resolved, and as I examine the vehicle the problem always remains. If I were to persue a lawsuit with this company for false advertisement, and pain and sufferring, would this be a valid case?

Your lawsuit would be for breach of contract and for deceptive trade practices. You probably have a good case; however, depending on the amount of damages vs. what a lawyer would charge you, it might not be worth pursuing.
