Legal Question in Consumer Law in Texas
I live in Austin, Texas. I would like to get out of my apartment lease with out having to pay a penalty or having any negative results on my credit rating. I do not want my actions to prevent me from renting in the future. I have lived in this apartment for over four years. I have eight months left on my lease and I pay $890 per month in rent. I have had an ongoing problem with water leaking into my apartment from my neighbors above me and the problem can't seem to be fixed. The apartment management has offered to move me to a different apartment, but I really want to leave this apartment complex. I would appreciate any ideas on the best way for me to proceed.

Tell them as nicely as you can [put this into a PAPER letter, and keep a copy] that (a) they haven't fixed the leak, and apparently they can't, and (b) you don't want to move into another aparement in the complex and (c) you're moving out at the end of the month.
They will probably put in a "negative" report with the credit bureaus no matter what you do. Your remedy is to write to the credit bureaus (again, PAPER letters) and tell them what happened; usually they'll attach a note in the credit report that tells your side of the story.
