Legal Question in Consumer Law in Texas

loan to friend

My husband made a deal with a friend to get us a house.We give him 10,000 dollars and he helps us get a house. That was four years ago. Two years ago we told him we just wanted the money back. He has said he would have money time and time again. We even tried to do monthly payments to us he never paid. Then he took off to Texas untill August. I just want 8,000 of what he owes us. I looked at small claims court but all I can get is 5,000 back. Is that my best bet or do I need to hire an attorney to help me.

You should NOT use small claims court. Any judgment from small claims can be appealed to district court for a new trial. That is Utah law. If the house is in Utah you can sue here and obtain a lien against the house, then force the sale of the house to get your money. It will take time.

If the house is out of state, or no longer exists, you will probably have to sue him in Texas.
