Legal Question in Consumer Law in Texas

A man stopped by our rural home to offer road repair on our dirt entry road with leftover materials from a bigger job earlier in the day. He verbally quoted my husband 60 cents a foot for the labor and materials. Nothing was put in writing. My husband assumed it was 60 cents per linear foot - big mistake - the guy claims he said SQUARE foot. We were charged approx TEN TIMES what we thought we were paying for leftovers. I paid because I felt I had no recourse because I was not there at the time the agreement was made and my husband was no longer there to take a stand against what we feel were exhorbitant charges. Anything we can do?

Unfortunately, you have lost a lot of power in this transaction by paying the price in full to the contractor.

Your only option would be to sue this man, but the amount of money at issue would probably mean that a law suit would not be worth the effort.

You may do some research and see what a comparable price is. If the $.60 per square foot is a standard price, then you probably don't have much hope on the case.

If you wish to pursue action in this case you should consult with an attorney.
