Legal Question in Consumer Law in Texas
nonpayment of earnest money
A title company was court ordered to refund earnest money in the amount of $2000 to us Nov 2006. We have repeatedly talked with the title company and given numerous stories, phone call with them stating the check is in the mail (2/6/07 and it is a local office). We do not know where to go or who to talk with. I am not sure what area of expertise this is. I have notes on each phone conversation with the title company.

Hard to know what is going on with the title company, but you are right to be concerned. It is worth your while and money to pay a local lawyer $100 to write a demand letter for the immediate return of the money.
Re: nonpayment of earnest money
If the court order was a judgment, you can execute upon that judgment. If the court order was an injunction, you can move to have the title company held in contempt of court for failing to follow the court's orders.
It will be worth your while to get with a lawyer that can lean on the title company and get your money.
