Legal Question in Consumer Law in Texas
I owe a jewelry store 368.00 I have not been able to make a payment for the last 60 days I told them that I would be in to make the payment in full if they gave me some time that was on the 24th I received a letter post-dated the 16th about THEFT OF SERVICES PENAL CODE 31.04 asking for the return of property, I have no property the last item that was added to my account was a wedding set I had taken out on credit but, came to find out that my wedding set the ones I took my vows with were not what they told me they were so I returned them I need to know if they can file charges on me

Under the facts you state, there probably has NOT been a crime committed, and their threat is phony (and illegal). In Texas, you aren't allowed to threaten to file criminal charges in order to collect a debt.
Keep the notice they sent you, and consider suing them.
