Legal Question in Consumer Law in Texas

If I purchased products form a P------- H----, Inc. party and hostess fails to delivery the product, do I have the right to sue and who do I sue? They are telling me that I need to file against the hostess of the party since she has the merchandise, I think I need to sue the company because she is a representative of them and they cashed my check not her. Please advice as the best way to handle. I was promised delivery in 3 weeks when I made the purchase, it has been 21/2 months.

If the price of the merchandise is under $5,000, you can sue in small claims court. You probably do not have a claim against the company itself unless they are at fault.
