Legal Question in Consumer Law in Texas
I have purchased a brand new mobile home. I did not use my land as collateral. I made a down payment instead. Now the mobile home has too many craftmanship defects. I have not made even one payment to the bank. I am considering defaulting on the loan. The mobile home company can come and get their defective trailer house. It is attached to a full concrete slab. I can have it effectively and safely unattached. Can the mobile home corporation, company, or even the bank legally put a lien on my land if I demand them to come retrieve the flawed mobile home?
1 Answer from Attorneys
Be careful, and do not act rashly. If the home is defective, then sue them; instead of letting them put a repo on your record and potentially take a judgment against you. Hire a civil litigation lawyer.
