Legal Question in Consumer Law in Texas
Purchased 2 ipod touches from Gamestop for Christmas gifts for kids. Turned out they are generation 2 and won't download games (finally got 2) All others said higher ios was required. Got on itunes and searched the Internetand there is no update for the ios higher than the one that came on them.
Gamestop says they don't take returns on opened items unless they are defective. They are selling an obsolete item. Is this against the law? All we want is to return them and pay the difference to a generation 4 which will allow the downloading of games.
Can we do anything?

I think that this is a matter where you will do better taking the issue up the corporate latter at GameStop than to take legal action. You have an especially good argument if a salesperson recommended the older generation and you relied on that representation.
