Legal Question in Consumer Law in Texas
I just purchased a mattress from Mattress Giant through a loan with Wells Fargo Bank on August 10, 2009. The mattress is not comfortable, so I asked them if I could return. I spoke with a sales person, she said no, sales is final because I did not purchase a fabric protector. On my customer sales invcoice receipt that I received, there is no signature that I agreed to there policy regarding there return.
Is it legal for them not to accept the return if there is no signature.

Yes it is.
You did not state that the mattress was defective, but that you didn't like it. That means you bought it, and you own it. Private stores, for the benefit of customers, can provide for returns in addition to what the law requires, but they are not obligated to do so. You chose the mattress. You received the mattress you chose. Unless the store wants to negotiate with you, you own it.
