refund of a firearm
I recently paid in full for a handgun and when they ran a background check it was denied, ( due to identity fraud on me ) I asked for a refund at the gun store he said no I had to wait until I was I could get cleared I since then have sent fingerprints to the FBI trying to get cleared and recieved a letter stating it could take up to 6 months I then asked if I could have a refund and He said no do I have any legal avenues to pursue, He still has possesion of the gun and I am out 616.00

This is a new one for me. I suggest you contact the appropriate state agency, probably DPS, and check with them is state or federal law requires this. If not, then a letter from a lawyer might solve the problem. You or I could also call the store and ask for the legal basis they claim for doing this.
