Legal Question in Consumer Law in Texas

Respected Madam/Sir,

I am in Houston Texas. On Monday Sept 30th in evening when I went to a Mazda showroom i test drove a car, later they reduced the price and I decided to buy a car, but different color one not the one which i test drove.

Now out of the 18000$ down payment I paid 5000$ on Monday with credit card and remaining 10,000$ through cash on Thursday Oct 3rd. and remaining 12,000$ finance.

But on Wednesday on Sept 2nd I went to the dealer and said I don't want the car, but the dealer said I have signed an agreement and deal is finalized.

NB: On Monday I didn't take the car out of showroom (even today i didn't sit in that car its still in showroom). I haven't paid the down payment completely.

I called other showroom and asked they told as long as the car is taken out of showroom by customer or down payment is made in full the deal is not finalized and its void.

But the dealer where i was supposed to buy the car is saying there is no such law and its already 3 days completed(said on fourth day). On contrary i had went on third day to cancel the deal (I have recorded all the conversation with the dealer on my iPhone).

Please help I am not sure if the deal is void as I haven't paid the down payment completely also not driven the car outside the showroom I was supposed to buy.

If you signed an agreement then you are generally bound by the terms unless your signature was obtained by fraud or force. It seems as though you voluntarily entered into a contract to purchase the car.

If the contract does not have a cancellation provision then you are bound to buy the car and pay the purchase price unless you can work something out with the dealership.
