Legal Question in Consumer Law in Texas
Return of merchandise ''charged back'' by credit card comp.
I sell used merchandise on ebay & agreed to use Paypal (www.x.com) for my customers to pay using their credit cards.
A buyer recently ''charged back'' an item thru their credit card company which resulted in Paypal placing that amount ($80.24) on hold-status - pending an investigation & determination of the facts.
I was told by Paypal that despite their best efforts the case was decided by the credit card company in their customer's favor. Insterad of being forthright & saying we're charging your account & keeping those funds that were on hold, they instead changed terminology & called the permanent taking of this money a ''chargeback fee'' - even though it was the same amount ($80.24). Afee for their efforts I suppose. I suppose I agreed to this in signing up with Paypal.
Now the customer has the merchandise AND my money. Paypal says they informed the credit card company to secure evidence of the merchandise's return prior to closing the case, but this never happened.
I don't have the merchandise back, nor do I have any evidence that it's ever been sent.
I feel like the victim of three conspirators: the customer, Paypal, & the credit card company.
If this happened to me, it could happen to anybody=class action suit.

Let's review the contract that you signed with Paypal and see if their conduct was authorized. You may contact me directly by e-mail.

The credit card company charged back PayPal, and PayPal charged back your acount. Now it's up to you to sue the buyer for either the money or the merchandise.
