Legal Question in Consumer Law in Texas

What are my rights with contract movers?

If a mover was eight hours late and caused me to miss work do I have to pay him?

If he continuously lied to me about the time of his arrival, and I missed several pre-scheduled appointments because of it, do I have to pay?

May I stop payment on a check I submitted to him?

Re: What are my rights with contract movers?

Your remedies for breach of contract are probably specified in your contract. Read through your moving contract and you will probably see what the remedies are for breach of contract.

If the mover is part of a nationally-recognized chain, your best bet is to contact them and negotiate with them. They will probably rebate some if not all of your price. If the contract was with a one-man outfit you could still cause yourself problems by stopping payment. In Texas you might run into problems with "theft by deception" or similar charges. Your best bet is to file a lawsuit in small claims court and pursue the matter in that way if you feel you have been damaged by the breach of the moving contract.

Good luck!
