Legal Question in Consumer Law in Texas
Selling a used car as new
My mother bought a 'new' Saturn with 300 miles on it. She was told that it had been ordered by another person, driven to another city - approx. 40 miles away. The person had not wanted it after all so it was driven back to our city. She has not been receiving all the new car literature usually sent out by Saturn so she called them. She gave them the VIN number and was told by the Saturn people in Spring Hill that that car had been bought by another person in the city and was still registered with them under his name. Isn't this fraud? She bought a 'new' car thinking she was the first owner. She got a 'new' car loan from the bank. The 'new' car was really used as it was bought by another person and brought back as a trade in. What are her rights here? Can she demand they take the car back and give her a really new car?

Probably. But she may need a lawsuit to get there.
