Legal Question in Consumer Law in Texas
While staying at a Hotel, the toilet overflowed unknown to the occupants while they were sleeping, causing water to leak down through the floor. Are the occupants liable for damages? This happened in Texas this year, 2010.

Whoever is responsible for the toilet overflowing is responsible for the damages. If the toilet overflowed from normal use by the occupant, then the hotel will be responsible for the damages. But if the occupants did something out of the ordinary that caused the flooding, then the occupants may be responsible.
