Unauthorized Auto Repair

Our daughter paid for repairs done to her vehicle. Before she picked up the car, she was called and told she also needed a new battery which would cost $65.00. She told the shop she did not want the battery and would take the car home from college to have her dad check on the battery. She paid for and picked up the car. Three days later, she was called and told that they had ''accidentally'' put a new battery in her car and she would need to pay for it or return it. Unfortunatly for her, they had also disposed of her battery. She has been repeatedly called and harrassed and was told today that they would put a lein on her car if she did not return the battery or pay for it. Is that legal?

It isn't legal. However, to avoid repossession of the vehicle, the charge should be paid, and then the shop sued for the unauthorized work.

The alternative is to wait for the car to be repossessed then sue for unlawful repossession; a far more expensive and time-consuming process.
