Legal Question in Consumer Law in Texas
Unauthorized Checking Account Deduction
Greetings ...
I am doing business with a web hosting service called ''Interland.'' I signed up for a monthly billing plan and recently extended my contract to 24-months so as to lower my monthly rate. On May 1st, Interland deducted $1,536.00 from my checking account (24 payments of $64.00). This brought my checking account to a negative balance, resulted in hundreds of dollars in overdraft fees and left me with nothing in my checking account. All of the plans I had made for the weekend had to be cancelled. These included home improvement efforts and recreational activities.
Is there any way I can seek punative damages for this unauthorized deduction? I consider the withdrawal to be nothing short of wire theft, as I never authorized such an outlandish charge.
I want to make sure Interland understands the gravity of this situation. Taking my business elsewhere deprives them of a mere $64.00 per month. Taking legal action might get the point across more clearly.
What can I do?

Re: Unauthorized Checking Account Deduction
First, carefully read your contract and the terms of all your agreements. Second, contact them and discuss it. If the charge was not authorized, your bank might not charge you the overdraft fees. If you can not come to agreement with the ISP, you might wish to consider small claims court.
